The Peppol Access Point Service Terms of Use establish the rules commonly applicable to the use of the Peppol Access Point Service operated by Fast Accounting Co., Ltd. (hereinafter referred to as “the Company”).
Article 1 (Definitions)
Unless otherwise defined below, the terms used in these Terms shall be as defined in the Fast Accounting Service Basic Terms of Use and other service-specific terms of use.
- “Service” refers to the Peppol Access Point Service operated by the Company, which has the functionalities defined in Article 3, Paragraph 1.
- “Peppol AP Terms” refer to these Terms (as posted on the Company’s website and updated from time to time, with the updated version applying after any such update) and any other rules established by the Company related to the Service, which are individually notified to Users or published on the Company’s website.
- “Transmission and Reception Data” refers to data transmitted or received, or intended to be transmitted or received, by the User through the Service.
- “Regulations” refer to Internal Regulations, Specification of Service Level Requirements, Peppol Authority Specific Requirements -Japan-, various Agreements, and all other rules that Open Peppol and the Peppol Authority require service providers to comply with when providing the Service.
Article 2 (Application of Terms)
- The use of the Service is subject to both the Fast Accounting Service Basic Terms of Use and these Peppol AP Terms.
- Users must agree to the Fast Accounting Service Basic Terms of Use and these Peppol AP Terms to use the Service (including receiving Transmission and Reception Data sent through the Service). Sending or using Transmission and Reception Data via the Service shall be deemed as the User’s agreement to these Terms.
- The Company shall provide the Service in compliance with the Regulations, and Users acknowledge and accept this in advance.
Article 3 (Purpose and Scope of Service)
- The Service provides a means for Users to transmit and receive accounting-related information in Peppol format and includes the following core functionalities. Users may utilize all or part of these functionalities based on their individual contracts:
- Transmission of accounting-related data created in Peppol format
- Reception of accounting-related data created in Peppol format
- Conversion of accounting-related data that is not in Peppol format (hereinafter, “Source Data”) into Peppol format
- Other functions related to transmission and reception
- The Company shall provide the applicant with reference materials, including functional descriptions of the Service. However, the Company does not guarantee that the features described in these reference materials will be compatible with other services used by the applicant, nor does it guarantee the Service’s suitability for the applicant’s intended use or its effectiveness.
Article 4 (Environment Setup, Information Provision, and Registration)
- Prior to using the Service, Users must provide the Company with the necessary information to enable the Service. Users must also promptly report any changes to such information.
- Users warrant the accuracy of the information submitted under the previous paragraph.
- Based on the provided information, the Company shall register or modify Peppol IDs related to the User and register necessary information with the Service Metadata Publisher provided by the Company or third parties and the Service Metadata Locator operated by Open Peppol.
- Users acknowledge that, where necessary for the provision of the Service, information relevant to the Service may be exchanged between the Company and other accounting-related service providers that have entered into agreements with the Company regarding the Service.
- After a valid individual contract has been concluded between the Company and the User, the Company shall complete the environment setup required for the User to access the Service by the agreed service start date specified in the individual contract.
- Users shall confirm that the initial setup has been completed and notify the Company using the prescribed form. If five (5) business days have elapsed since the setup completion or the service start date, whichever comes first, the User shall be deemed to have started using the Service.
Article 5 (Data Transmission, Content, and Storage)
Users agree to the following conditions when using the Service:
- Data mapping for converting Source Data into Peppol format may result in missing content, bugs, or failure to complete the conversion.
- The Company shall verify whether Transmission and Reception Data comply with technical rules and schemas defined by Open Peppol or Peppol Authority, but the Company shall not be responsible for the accuracy of such verification results.
- If the transmitted data is not Peppol-compliant or the recipient does not have a Peppol ID or lacks an environment to receive Peppol-format data, the data may not reach the recipient.
- The User acknowledges that Peppol-format data transmitted to the User’s Peppol ID will be received and delivered to the User, even if the recipient did not intend to receive it.
- The Company makes no guarantees regarding the accuracy, completeness, legality, or other aspects of Transmission and Reception Data. Any disputes or issues related to the transmission and reception of such data shall be resolved between the sender and the recipient.
- The Company does not guarantee storage of Source Data or Transmission and Reception Data as part of the Service. Users shall back up their data on their own accounting systems or other platforms.
- The maximum file size for data transmission and reception shall be 100MB per file, and the total data volume allowed per month shall be as determined by the Company and notified to Users in advance.
Article 5-2 (Data Collection and Purpose of Use)
- The Company shall collect and store Transmission and Reception Data, operation logs, and other Service-related data as required by the Regulations. Such data shall be stored within Japan.
- The collected data shall be used and disclosed only for the purposes defined in the Regulations, including but not limited to:
- Header Information of Transmission and Reception Data: Reported to Open Peppol for compliance, operational improvements, and statistical analysis.
- Transmission and Reception Data: May be disclosed to parties directly involved in the transmission, such as Users, other Access Point providers, Open Peppol, or Peppol Authority, upon reasonable request.
- Operation Logs: Used for compliance verification and statistical purposes in accordance with Open Peppol’s regulations.
- User-provided information from Article 4, Paragraph 1: May be disclosed to Open Peppol or Peppol Authority for compliance and statistical analysis.
- The Company shall not use collected data beyond the scope defined in this article, except where the User utilizes other Company services beyond this Service.
Article 5-3 (Suspension of Service Use)
The Company may suspend the User’s access to the Service under the following circumstances:
- If the User violates the Fast Accounting Service Basic Terms of Use, Peppol AP Terms, or provides false information to the Company.
- If the Company determines that the User is using the Service for fraud, spam, or other criminal activities.
- If Open Peppol or Peppol Authority instructs the Company to suspend the User’s access due to the above or similar reasons.
Article 6 (Support Services)
- The Company shall provide email-based support for inquiries related to the use and operation of the Service during business hours.
- The Company does not guarantee that support services will meet specific objectives or resolve all issues.
